TOUR OPERATOR: Pesach Luxury in Mexico, herein referred to as “Tour Operator”, has arranged the Passover vacation packages described in reservation form/confirmation. Pesach Luxury in Mexico acts as the tour operator for the Passover vacations.
RESERVATION: Reservations are subject to availability and are conditioned upon receipt by us of a non-refundable deposit in the amount of $2000 per room. Final payment is due by February 20, 2018. Payments received after the above dates will be subject to any additional costs incurred or loss of the Early-Bird deal. The balance may be paid by check, money order or cash. Prior to attendance at the program, a major credit card authorization form must be filled out and signed. This is for any incidentals which you or anyone in your party may incur during the program.
PASSPORTS AND TRAVEL DOCUMENTS: Everyone traveling to Mexico (including newborns, infants and children) must have a valid passport.
CONDITIONS AND RESPONSIBILTY: Tour Operator is responsible for arranging the Passover Program offered. Every effort will be made to accommodate room requests. However, these requests cannot always be guaranteed with 100 percent certainty due to variables beyond our control and the hotel’s control. Tour Operator in arranging any accommodations or in rendering other services in connection therewith does as agent for the individual desiring such travel accommodations upon the express condition and your agreement and understanding that we shall not be liable for, AND YOU HEREBY RELEASE US: from any injury, loss, damage, accident, delay, irregularity or expense arising from the use of any travel or lodging facilities, accommodations or services provided in connection with such individual’s travel plan, for any injury, loss, damage, accident, delay irregularity or expense arising from strikes, war, weather, quarantines, sickness, government restrictions or regulations, from any act of omission by individual, or corporation furnishing transportation, sightseeing, hotel accommodations or any other services in connection therewith, for any additional cost or expense due to disruption or change of advertised schedules, rates or services or for any cause.
CANCELLATIONS: No refund will be made if you’re attendance at the program is cancelled by you less than 30 days prior to the scheduled start of the program. If your cancellation notice is received 30-60 days prior to the scheduled start of the program, you forfeit your deposit and 75% of program price. If your cancellation notice is received 60-89 days prior to the scheduled start of the program, you forfeit your deposit and 50% of program price. If your cancellation notice is received 90-120 days prior to the scheduled start of the program, you forfeit your deposit and 25% of program price. Once the program is in progress, no refunds are considered. Cancellations must be made directly with us and must be received in writing at our office before they will be acknowledged. Please be sure to obtain proof of mailing when cancellation penalties are in effect. We recommend that you buy travel insurance. Tour Operator holds the rights to cancel this program for any reason for a full refund and/or make any alterations necessary for the proper operation of the program. Tour Operator will not be liable for loss of travel tickets.
VIDEOTAPE/ PHOTOGRAPHIC RELEASE: By virtue of your presence, you understand and give permission for you to be photographed or videotaped and you give permission to use photographs or videography without limitation. You explicitly release Tour Operator from any liability, loss, expense or claims arising from distribution, broadcast, sale or use of your picture, voice or likeness.
DISPUTE RESOLUTION: Any dispute arising between Tour Operator and participant, or relating in any way to the travel envisaged by this document or the confirmation shall be resolved in arbitration before the Beth Din of Mexico (affiliated with the Rabbinical Council of America). The parties consent to the jurisdiction of the courts of Mexico, City for the purpose of enforcing any determination of the Beth Din, and enforcing this arbitration clause. Any arbitration with respect to a dispute relating to the travel envisaged by this document or the confirmation shall be commenced within two months of the last day of the event.
